By using this website, you agree to be bound by these terms; therefore, we recommend that you read them carefully. If you do not agree with them, you must leave the website.

Preliminary Provisions

These terms of purchase apply to all products from the brand Bardinet Wines, S.A.U. purchased through the website http://www.bardinetwines.com/ (hereinafter referred to as the "Website").

By placing an order, you warrant that you are over 18 years of age and possess the legal capacity to enter into binding contracts.

Orders may only be placed for the acquisition of goods for personal use, not for resale. Any resale or distribution of products purchased through the Website is strictly prohibited.

We reserve the right to cancel fraudulent, false, or speculative orders, as well as orders placed by a customer with whom there is an ongoing dispute or disagreement regarding previous transactions. We also reserve this right if there are reasonable grounds to believe that the customer is violating any of these terms of purchase or is engaging in any criminal activity.

We may update these terms of purchase, as well as the legal notice, at any time. You may consult and print the updated version of both texts at any time by clicking on the "Terms of Purchase" and "Legal Notices" links.

User Obligations

As a user, you are required to provide Bardinet Wines, S.A.U. with all data necessary to access and use the services on this website. Such data must be accurate and up-to-date, and you consent to our use of this information to contact you if necessary.

It is essential that you provide all information designated as mandatory; failure to do so will prevent us from processing your order. We shall not be held liable for any delays or delivery errors resulting from incorrect or omitted data.

Users must make appropriate use of the services provided on the website, in full compliance with the law, and must not engage in any activity that hinders or interferes with its operation.

Security Measures

We will implement all reasonable mechanisms at our disposal to ensure that your personal data remains secure at all times. However, you acknowledge that no data transmission over the Internet can be guaranteed to be entirely secure against access by unauthorized parties; consequently, we cannot be held liable for any security breaches, unless such breaches are the result of our own negligence.

Furthermore, you must adopt the necessary security measures—both personal and technical—to maintain the confidentiality of your username and password. You must also notify us immediately in the event of the loss, theft, or unauthorized access to your username and password, or if they become known to any third party.

Conditions applicable to orders

All products offered on this website are sold directly by Bardinet Wines, S.A.U. (Tax ID/CIF: A08974479), with its registered address at Finca Manlleu, s/n, 08732 Castellví de la Marca (Barcelona).

You may browse the website until you find the desired items. Once you have located an item, click on it to access detailed information provided on the website. From there, you can add the product to your order.

If you are placing an order with us for the first time, you will be asked to register by entering your email address and a password, which will allow you to create and access your account.

Once logged into your account, you may continue with your purchase and, finally, confirm your order.

Scope of the Offer

The geographical delivery areas are those currently active on our website—selectable as part of the shipping method—specifically Spain. By placing an order, you confirm that you are a customer residing in one of these areas. Any order specifying a delivery address outside of these areas will be automatically cancelled.

Availability

All orders are subject to availability. We are not liable for any lack of stock or unavailability of products.

Please consult the selection of items available for purchase through the website, as not all items that may be featured on our website or in other presentations are available for sale in this manner.

If a product becomes unavailable after an order has been placed, you will be notified as soon as possible via email or telephone, and the order will be cancelled.

Should you have any questions, please contact our customer service team.

Contract with Bardinet Wines, S.A.U. and Order Acceptance

An order will not be accepted by us until the payment has been charged to your account. Upon confirming your purchase, you will receive an email acknowledging receipt; however, this does not constitute acceptance of the order, as all orders are subject to our subsequent review and approval.

We will confirm the acceptance of your order via an email informing you that the order is being dispatched. Only at that point is a contract formed between you and us, and it applies exclusively to the products listed in said dispatch confirmation.

Order Confirmation and Cancellation

Before finalizing your order on the website, you may review all associated details—including a breakdown of costs (taxes, shipping fees, selected items, etc.)—and make any necessary corrections.

Once an order has been confirmed, it cannot be modified or cancelled through the website; you must contact us directly. In such cases, an order may only be modified or cancelled if the items have not yet entered the dispatch phase at our warehouses.

Currency, Taxes, and Pricing

In accordance with current legislation, all purchases made through our website are subject to Value Added Tax (VAT), with the exception of orders destined for the Canary Islands, Ceuta, and Melilla. The applicable tax rate will be the one legally in effect at the time of purchase.

All prices are displayed in euros (€) and should be considered the final price to be paid by the customer (inclusive or exclusive of VAT, depending on the delivery territory, as indicated in the preceding paragraphs).

Payment Methods and Security

Any order placed must be paid for immediately upon confirmation. Orders will only be processed once payment has been completed and verified. Payment must be made via credit or debit card (issued by an institution with its registered office in Spain).

The prices applicable to each product are those published on the website and are applied automatically during the final stage of the purchasing process. The customer acknowledges that the price of certain products may change in real time. In any such case, users will always be notified in advance.

To pay for products purchased via the website, users may use the following payment methods:

Credit card, via a payment gateway (Virtual POS): In this case, the user’s details and purchase information are entered and transmitted directly by the user to the payment gateway provider. We do not store or handle this data; it is registered directly within the payment gateway of the relevant financial institution. For enhanced security, we utilize a secure e-commerce authentication service—a system established by Visa, Mastercard, and Eurocard—whereby the customer authenticates themselves with their issuing bank, and the merchant authenticates themselves with their acquiring bank. The order amount will be charged to your card; you will be required to provide the card number, expiration date, and the security code (CVV2/CVC2) found on the back of your card. If your card is enrolled in a secure authentication program, you will be prompted to provide the necessary security codes. Purchases may be paid for via the Sistema REDIS banking gateway.

The charge will be processed in real time via this payment gateway. If, for any reason, the charge cannot be successfully processed, the order will be automatically cancelled.

For any information regarding an order, users may contact the provider’s customer service department by calling +34 938918281 or by sending an email to mgimenez@bardinetwines.com.

Discount Codes

From time to time, promotional codes may be offered, providing a discount on one or more products, an entire order, or shipping services.

The terms of use for any discount code will be specified at the time of issuance. However, the following terms and conditions apply to all promotions, contests, and discount codes offered by our company (unless otherwise stated):

– Only one promotional code may be used per order.

– A promotional code cannot be used after an order has been placed.

Deliveries: types, timeframes, and issues

Delivery can be made to an address of your choice (excluding P.O. boxes). Home delivery of orders is handled by a logistics provider (Correos Express) during standard business hours. If no one is present at the address when the courier arrives, they will leave a note, and their customer service department will attempt to contact you to arrange the delivery. Shipping costs depend on the specific product, starting at €6 per box. Delivery timeframes are calculated based on business days—Monday through Friday—as the courier company does not make deliveries on Saturdays, Sundays, or public holidays.

The standard delivery timeframe is approximately 48 to 72 business hours following order approval. This period may be extended during sales events, the Christmas season, or in the event of customs procedures or other circumstances—including, but not limited to, geographical distance, weather conditions, war, strikes, government intervention, or failures by our suppliers—as well as any issues attributable to the logistics provider responsible for the delivery. We are not liable for any delays that may arise due to the aforementioned reasons. The stated delivery timeframes will be longer for the Balearic Islands.

If the packaging of an order appears damaged at the time of delivery, you must open the package in the presence of the courier to verify the condition of the items. If any damage is found, you must note it on the delivery receipt and contact us within 24 hours. We will repair or replace, at no cost to you, any items damaged or lost during transit, provided that you notify us of the incident as soon as possible.

Once the order has been delivered, it becomes your property; therefore, you are responsible for any damage that may occur thereafter.

Return, Exchange, and Refund Policy

Right of Withdrawal:

The customer has a maximum period of 14 calendar days—from the date of delivery of the product or from the conclusion of the contract in the case of a service—to notify us of their decision to withdraw, in whole or in part, from the purchase of the product or service, in accordance with applicable law. Returns made within this timeframe will not incur any penalties. However, the customer is responsible for all shipping costs.

Please mark the items you wish to return on the purchase receipt included with your order.

Items must be returned in the original packaging in which they were delivered by the logistics provider.

Once we have received the returned items, we will verify that they match the return packing slip and ensure they are in perfect, usable condition, complete, in their original packaging, and show no signs of having been used. If the condition of the returned items is satisfactory, we will issue a refund for the amount originally paid, credited back to the same credit card used for the purchase, within a maximum period of one month. If the condition is not satisfactory, we will contact you to arrange for the return of the items to you (any shipping costs associated with this return shipment will be your responsibility).

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of your right of withdrawal before the withdrawal period expires. You may use the following return form—either by copying it into an email or printing it out: click here.

Exceptions to the right of withdrawal:

Please note that for purchases of wine, sparkling wine, or other food products, for reasons of health protection and hygiene, you will lose your right of withdrawal if you open the bottle or any other container in which the product is sold. This means that if you open the packaging, you will not be able to return the product.

Product Warranty

The warranty period is two years. However, this does not cover defects resulting from negligence, impact, incorrect use, improper handling, etc., nor does it cover wear and tear from normal use. In the event that a defect is caused by misuse, any repairs will be billable, subject to a prior cost estimate.

For issues covered by the warranty, the resolution may involve repair, replacement of the item, a price reduction, or a refund, in accordance with legal requirements. Bardinet Wines, S.A.U. will process exchanges or returns, provided that:

You must notify our Customer Service department within two months. This step is mandatory, regardless of the reason for the return. You may do so by sending an email to mgimenez@bardinetwines.com, attaching a copy of your receipt or invoice and including the order number in the email subject line. We will then provide you with instructions on how to proceed with the return of the item.

The item being returned must be properly packaged. The packaging must be in perfect condition, and all original accessories and instructions must be included for the return to be accepted.

Failure to meet the two-month notification deadline does not result in the loss of your statutory warranty rights; however, the customer shall be held liable for any damages or losses actually caused by the delay in notification.

Commercial warranty: Manufacturers may offer additional warranties, the scope and duration of which vary depending on the product and brand. Such warranties are the sole responsibility of the manufacturer providing them.

Under the Royal Legislative Decree, the seller is required to deliver to the consumer a product that conforms to the terms of the sales contract (Article 114), which states:

"The seller is obligated to deliver to the consumer or user products that conform to the contract, and shall be liable for any lack of conformity that exists at the time of the product's delivery."

The warranty period begins on the date of purchase, in accordance with the aforementioned Article 123 of the Royal Legislative Decree.
